TERMS AND CONDITIONS

SCOPE

These Terms and Conditions apply to all orders placed through the JOYAVELLE online shop.

A consumer is any natural person who enters into a transaction predominantly for purposes that cannot be attributed to their commercial or self-employed professional activity.

PRODUCTS AND PRODUCT INFORMATION

JOYAVELLE offers jewellery and related products. The main characteristics of each product are shown on the relevant product page.

We make every reasonable effort to display product colours and details accurately. However, colours may appear differently depending on the customer’s screen and device settings.

Handcrafted components, hand-cut glass, natural gemstones, cultured pearls and individually finished surfaces may show slight variations in colour, shape, texture and size. Such variations are characteristic of these materials and do not constitute a defect, provided that the product corresponds to the agreed description.

All measurements stated on product pages are approximate unless expressly stated otherwise.

CONCLUSION OF THE CONTRACT

The presentation of products in the online shop does not constitute a legally binding offer. It is an invitation to place an order.

Customers can add products to the shopping cart and correct their order information before submitting the order.

By clicking the final order button, the customer submits a binding offer to purchase the products contained in the shopping cart.

After the order has been submitted, the customer receives an automatic order confirmation by email. This automatic confirmation acknowledges receipt of the order but does not necessarily constitute acceptance of the order.

The purchase contract is concluded when JOYAVELLE expressly accepts the order, confirms shipment or dispatches the goods, whichever occurs first.

If an order cannot be accepted, any payment already received will be refunded promptly.

PRICES AND SHIPPING COSTS

The prices displayed in the online shop are total prices and include any legally applicable value-added tax, where applicable.

Shipping costs are shown separately during checkout before the customer submits the order.

For deliveries outside the European Union, additional customs duties, import taxes or other charges may be imposed by the destination country. These charges are not collected by JOYAVELLE and must be paid by the customer to the relevant authorities or service providers.

PAYMENT

The payment methods available for an order are displayed during checkout.

Payment is due according to the conditions of the payment method selected by the customer. Payment processing may be provided by Shopify or another payment service provider.

The customer must provide complete and accurate payment, billing and contact information.

DELIVERY

Orders are delivered to the shipping address provided by the customer.

Available delivery destinations, shipping options and shipping costs are displayed during checkout.

Unless otherwise agreed, orders are normally processed within 1–3 business days after payment has been received.

Estimated delivery times are provided in the Shipping Policy. Delivery times may be affected by weekends, public holidays, customs procedures or circumstances outside our reasonable control.

If delivery is delayed significantly or a product is unavailable, we will inform the customer as soon as reasonably possible.

For consumer purchases, the risk of accidental loss or damage generally remains with JOYAVELLE until the goods are delivered to the customer or to a third party designated by the customer who is not the carrier.

RETENTION OF TITLE

The goods remain the property of JOYAVELLE until the purchase price has been paid in full.

RIGHT OF WITHDRAWAL AND RETURNS

Consumers have a statutory right of withdrawal where applicable.

Full information regarding the right of withdrawal, return procedure, return costs, refunds and the model withdrawal form is provided in our Return and Refund Policy.

The statutory right of withdrawal is not restricted by these Terms and Conditions.

DAMAGED, DEFECTIVE OR INCORRECT GOODS

Customers should inspect their order after delivery and contact us promptly if an item is damaged, defective or incorrect.

Customers can contact us at thejoyavelle@gmail.com and should include the order number and photographs where possible.

The customer’s statutory rights concerning defective goods remain fully applicable. Nothing in these Terms and Conditions limits the customer’s statutory warranty rights.

CARE OF JEWELLERY

Customers should follow the care instructions provided on the relevant product page.

Unless specifically described as suitable for such use, jewellery should be protected from water, perfume, cosmetics, hairspray, perspiration, cleaning agents and other chemicals.

Normal wear, scratches, tarnishing or changes caused by improper use, unsuitable storage, failure to follow care instructions or ordinary ageing do not constitute a product defect.

This provision does not limit statutory rights where the product was already defective at the time required by applicable law.

PROMOTIONAL CODES

Promotional codes are valid only during the stated promotional period and subject to any conditions communicated with the promotion.

Unless expressly stated otherwise, promotional codes cannot be combined and cannot be exchanged for cash.

A promotional code must be entered during checkout before the order is submitted. It cannot normally be applied retrospectively.

Statutory consumer rights also apply to discounted products.

INTELLECTUAL PROPERTY

The text, photographs, graphics, logos, product descriptions and other content displayed in the JOYAVELLE online shop are protected by applicable intellectual-property laws.

Content may not be copied, reproduced, distributed, modified or used for commercial purposes without prior permission from JOYAVELLE or the relevant rights holder.

LIABILITY

JOYAVELLE is liable without limitation for damage caused intentionally or through gross negligence, for injury to life, body or health, under the German Product Liability Act and in other cases where liability cannot legally be excluded or limited.

In cases of slight negligence, JOYAVELLE is liable for the breach of an essential contractual obligation whose fulfilment is necessary for the proper performance of the contract and on whose fulfilment the customer may ordinarily rely. In such cases, liability is limited to foreseeable damage typical for the contract.

The above limitations also apply to the legal representatives, employees and agents of JOYAVELLE.

Statutory consumer and warranty rights remain unaffected.

THIRD-PARTY SERVICES

The online shop is hosted by Shopify. Payment, delivery or other functions may be provided by third-party service providers.

The use of those services may additionally be subject to the terms and privacy information of the respective provider. However, purchases made through the JOYAVELLE online shop are contracts between the customer and JOYAVELLE.

DATA PROTECTION

Information about the collection and processing of personal data is provided in our Privacy Policy.

APPLICABLE LAW

The law of the Federal Republic of Germany applies, excluding the United Nations Convention on Contracts for the International Sale of Goods.

For consumers, this choice of law does not deprive them of mandatory consumer protections provided by the law of the country in which they normally reside.

The statutory rules regarding jurisdiction apply. If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is Augsburg, Germany, where legally permissible.

ONLINE DISPUTE RESOLUTION

JOYAVELLE is not willing or obliged to participate in dispute-resolution proceedings before a consumer arbitration board, unless legally required to do so.

SEVERABILITY

If an individual provision of these Terms and Conditions is or becomes invalid, the remaining provisions remain unaffected. The applicable statutory provision will apply in place of the invalid provision.
